Towards a paperless office: Nothing to fear, but fear itself!
On 1 February 2017, Labgroup became the first company in Luxembourg to achieve PSDC (Provider of Digitalisation and Conservation Services) certification from ILNAS (the Luxembourg Institute for Normalisation, Accreditation, Security and Quality of products and services). Just over one year later, Jean Racine, Labgroup’s chief business development officer, talks about the importance of the certification and how it has impacted Labgroup’s service offering to clients. He also calms the fears of those who hesitate to go digital.
Margaret Ferns: Why was it important to get PSDC certification?
Jean Racine: Archiving has been Labgroup’s core business for 40 years and, over this time, we have invested heavily in information technology in order to help our customers plan for the (very) slow death of paper. Qualifying for PSDC certification was the logical next step. It was also essential to boost digital trust at a time when businesses are likely to outsource non-core activities (such as data archiving) in a context of a heavy regulatory burden, especially with regards personal data protection– GDPR regulation.
MF: In what ways has it altered Labgroup’s service offering to clients?
JR: Although information security is always a major priority for us (for example, we have been an ISO 27001 certified company since 2014), there is always room for improvement. Under the act establishing the PSDC status (the Law of 25 July 2015 relating to electronic archiving), we are required to implement increased security measures. For example, traffic on internal corporate networks must now be encrypted. PSDCs are also obliged to submit complete and detailed information on infrastructure and technical installations, safety systems and procedures, applicable standards and workflow management, etc.
Labgroup has taken its role as advisor seriously by developing a specific archiving project methodology based on best management practices. As a result, interaction between parties and exchanges among persons are structured, scheduled, and accordingly more constructive, building a trusting relationship.
MF: With regards to PSDC, which sectors of activity do your clients come from?
JR: It should be noted that PSDC services (paper documents digitisation and electronic records preservation), are available not just to companies in Luxembourg but worldwide. Indeed, among our first customers, we counted several significant foreign insurance companies, which tend to be the most prolific in terms of producing records.
Locally, the first organisation to trust Labgroup as a PSDC was not a business, but the University of Luxembourg. One year after the formalisation of Labgroup’s PSDC status, however, most demand comes from the financial sector. Surprisingly, we have also seen demand from the construction sector for the digitisation and archiving of supplier invoices.
MF: Have you observed any hesitation in moving forward with digitalisation in any sectors?
JR: The current situation is rather paradoxical. Indeed, despite the fact that we are subject to the same obligations of professional secrecy as a PSF, companies managing highly confidential information have always rejected the idea of digitising their files, since that meant that the documents would leave their premises.
Today, however, we find that it is these same companies that are the first to initiate the most projects of native digitisation (without passing through the paper stage), in order be able to offer their customers all over the world the opportunity to subscribe and operate online. The fact that contracts and transaction notices are processed by a third party such as Labgroup significantly limits the risk of disclosure. Don’t forget that data encryption is very difficult to implement on paper, not so digitally.
MF: Does increasing digitalisation mean less control of data for your clients?
JR: In fact, it is just the opposite. Where a physical item can only be stored in a single place and classified according to a single criterion (e.g. name of author, title…), an electronic record may be searched and retrieved in many ways, each one corresponding to the specific needs of the user. In a similar vein, where access to paper documents requires physical movements and complicated key-based security management, the confidentiality of an electronic record can be managed through indexes/metadata, subject to instant amendment.
In general terms, thanks to digitalisation, information holders have the ability to have total control of their data with regards to its readability, intelligibility, integrity, confidentiality and availability.

Raiffeisen has entrusted Lab Luxembourg S.A. (Labgroup) and Numen Europe with the implementation of a digitisation and electronic archiving solution for its daily business requirements.

The project aimed at optimising the management, the protection and the preservation of documents in the perspective of a “Paperless Office”, and this includes three steps:
- The digitisation of client files that represents, the collection of 8 million pages;
- The daily digitisation of paper documents concerning daily banking activities;
- The archiving of documents, existing electronic or digitised (contracts or operations in electronic form).
The electronic copies created by a PSDC according to the regulation have the same probative value as the original documents (which henceforth can be destroyed). Therefore, all holders of information such as Raiffeisen Bank can entrust Labgroup with their digitisation and conservation operations, in complete safety, with the guarantee of the Luxembourg State.
The combination of the skills of both companies has been a successful collaboration within and beyond Luxembourg. Thanks to this partnership, Numen Europe and Labgroup can take charge of physical and electronic documents life cycle from their collection to their certified destruction. Both also guarantee business continuity thanks to the redundancy of their tools and certifications.
The CSSF (Luxembourg Financial Services Supervisory Authority) and the ILNAS (Luxembourg Institute for Standardisation, Accreditation, Security and Quality for Products and Services) monitor Labgroup and Numen Europe as being a PSF (Professional of the Financial Sector) and PSDC (Provider of Digitisation and Conservation Services).

Un nouvel arrivant dans la communauté des PSDC !
Dans le cadre de la loi du 25 juillet 2015 sur l’archivage électronique, le Luxembourg compte désormais quatre Prestataires de Services de Dématérialisation ou de Conservation (PSDC), qui ont obtenu la certification correspondante avant d’être agréé par l’ILNAS (Institut Luxembourgeois de la Normalisation, de l’Accréditation, de la Sécurité et qualité des produits et services).
En effet, en date du 26 février 2018, le SIGI (Syndicat Intercommunal de Gestion Informatique), partenaire des administrations communales et nationales, a rejoint Labgroup sur la liste officielle, en tant que PSDC de conservation.
Cela renforce la position de précurseur du Luxembourg en matière d’archivage électronique et augure bien de son développement dans le secteur administratif.
Pour rappel, le 1er février 2017, Lab Luxembourg S.A. (Labgroup) fut le premier PSDC agréé, aussi bien pour la dématérialisation que pour la conservation.
Le statut de PSDC garantit la fidélité de la digitalisation des documents papier et l’intégrité de la conservation des documents électroniques. C’est donc en toute sécurité, avec la garantie de l’État luxembourgeois, que les détenteurs d’informations de tout pays peuvent confier à un PSDC, tant leurs opérations de dématérialisation que de conservation, et bénéficier de la présomption de conformité de la preuve électronique à l’original.
En résumé, le statut PSDC propose un niveau de sécurité inédit !

Témoignage d’un PSDC-Labgroup lors de la visite ARTCI au Ministère de l’Économie.
Ce 19 mars, le Ministère de l’Économie – Luxembourg a eu le plaisir d’accueillir dans ses locaux deux représentants de l’Autorité de Régulation des Télécommunications de Côte d’Ivoire (ARTCI).
Suite au vote d’une loi sur l’archivage électronique, les visiteurs venaient s’informer de la façon dont le Luxembourg a implémenté sa règlementation, ainsi que le statut de Prestataire de Services de Dématérialisation et/ou de Conservation (PSDC).
Introduit par le conseiller au Ministère de l’Économie, François Thill, le sujet a été développé par Alain Wahl, Head of Digital Trust Department de l’ILNAS (Institut Luxembourgeois de la Normalisation, de l’Accréditation, de la Sécurité et qualité des produits et services). Puis Jean Racine, Chief Business Development Officer de Labgroup, a apporté le témoignage de la première société ayant obtenu le statut de PSDC au Luxembourg.
En effet, le 1er février 2017, Lab Luxembourg S.A (Labgroup) devenait le premier PSDC certifié, aussi bien pour la dématérialisation que pour la conservation. C’est donc en toute sécurité, avec la garantie de l’État luxembourgeois, que les détenteurs d’informations de tous les pays peuvent confier à Labgroup tant leurs opérations de dématérialisation que de conservation. La visite s’est déroulée en comité restreint ce qui a permis un vrai échange d’informations en soulignant l’importance de l’économie digitale, la sécurité de l’information, du statut PSDC et surtout les opportunités d’un partenariat entre les deux parties, autant au niveau technique que stratégique. Les discussions se sont avérées fructueuses et laissent à presager une collaboration à long terme entre ARTCI et les acteurs luxembourgeois.

Article Paperjam – Un intérêt marqué pour les nouveaux PSDC

La certification, cette année, des deux premiers prestataires de services de dématérialisation et/ou de conservation (PSDC) de documents marque les premiers effets concrets de la nouvelle loi sur l’archivage électronique, qui fait du Luxembourg un précurseur en la matière.
Longtemps perçu par les PMI et les PME comme une contrainte parfois coûteuse découlant d’une obligation légale, l’archivage a considérablement évolué ces dernières années au Luxembourg.
Si le papier a longtemps été la règle, c’est l’archivage numérique qui tend à le suppléer aujourd’hui, avec tous les avantages qu’il représente en termes de gain de place, de temps, de sauvegarde à long terme et de sécurité.
Quelques prestataires de services et hébergeurs à travers le pays, pour la grande majorité estampillés professionnels du secteur financier (PSF) de support, se sont déjà spécialisés dans ce domaine et proposent, pour la plupart, des solutions clés en main de dématérialisation adaptées à tous les corps de métiers, selon leurs besoins spécifiques.
Législation innovante
Contrats, factures, extraits bancaires, actes notariés, voire plans d’architectes ou dossiers médicaux, peuvent désormais passer d’une version papier à une version en mode PDF ou en mode image, par le biais d’une transformation numérique, complétée le plus souvent par différentes solutions de gestion de ces documents. Le tout en conservant leur valeur légale lorsque l’opération est effectuée par une entreprise certifiée.
Encouragé par la Commission européenne, qui a mis en place en 2014 le règlement eIDAS (Electronic Identification and Trust Services) sur l’identification électronique et les services de confiance, l’archivage numérique — au-delà de la simple sauvegarde ou du stockage de documents — a toutefois franchi un nouveau pas au Grand-Duché, grâce à la nouvelle loi du 25 juillet 2015 sur l’archivage, intervenue près de huit ans après sa mise en chantier.
Cette loi est venue compléter le règlement eIDAS et, en l’absence d’une réglementation similaire en Europe, a permis au Luxembourg de se positionner en tant que précurseur en la matière.
Elle n’est véritablement entrée en vigueur que cette année, avec la certification des deux premiers prestataires de services de dématérialisation et/ou de conservation (PSDC) que sont Labgroup, depuis le 1er février dernier, et, plus récemment encore, Victor Buck Services, pour le groupe Post, depuis le 12 juillet.
Contrairement aux PSF et PSF de support, qui sont un agrément du ministère de l’Économie, le PSDC — défini par la loi — est un statut qui s’obtient par une certification délivrée par l’Institut luxembourgeois de la normalisation, de l’accréditation, de la sécurité et qualité des produits et services (Ilnas).
Avantages compétitifs
«Ce contexte légal, issu de la volonté de longue date du Luxembourg de devenir le coffre-fort électronique de l’Europe, est particulièrement important», explique Jean Racine, chief business development officer chez Labgroup.
«Alors que, d’habitude, la loi est en retard sur les pratiques, là, nous avons une législation en avance sur ce qui se passe sur le terrain pour de très nombreuses années, et qui tire donc le marché, les changements et l’évolution des états d’esprit», ajoute-t-il. «Par le biais de ce nouvel outil juridique, les entreprises luxembourgeoises disposent d’une formidable opportunité de se différencier, avec des services numériques innovants, tels que ce coffre-fort numérique pour les documents à valeur légale», considère, pour sa part, Roland Bastin, partner information and technology risk chez Deloitte Luxembourg. «Et dans une tendance européenne d’évolution vers une économie numérique, cette nouvelle loi permet d’accentuer l’attractivité de la Place luxembourgeoise auprès des sociétés internationales.» Selon lui, «l’industrie des PSF pourra bénéficier des avantages compétitifs offerts par ce nouveau cadre légal». Et, affirme-t-il,«les PSF de support auront l’occasion d’étendre leurs activités grâce au statut de PSDC, et pourront répondre aux demandes des clients confrontés à la problématique de la transformation digitale, tout en gardant la valeur probante des documents dématérialisés».
Débuts prometteurs
Jean Racine précise toutefois que si le périmètre de la loi offrant cette garantie d’État via les PSDC est pour l’instant réduit aux deux types de documents que sont les actes sous seing privé — autrement dit les contrats — et les documents comptables, des projets de loi sont en cours pour élargir ce périmètre.
«Bientôt, à l’échelle de temps de l’archivage, de nombreux autres documents, notamment administratifs, pourront aussi être dématérialisés, et leur version papier détruite, et un jour qui n’est pas si éloigné, on assistera à un renversement avec la version électronique, qui deviendra l’original, et le papier la copie», ajoute-t-il encore.
Depuis qu’il bénéficie du statut de PSDC, Labgroup indique ne plus savoir où donner de la tête, nombreuses étant les PME et PMI luxembourgeoises et étrangères suffisamment matures pour s’intéresser à ces nouvelles solutions d’archivage. En volume, la plus importante serait une société britannique sans siège ni activité au Luxembourg.

At a press conference held at the Ministry of the Economy on Wednesday 1st of February, Étienne SCHNEIDER, Deputy Prime Minister & Minister of the Economy, Jean-Marie REIFF, Director of ILNAS (Luxembourg Institute for Standardisation, Accreditation, Security and Quality for Products and Services) and Bernard MOREAU, CEO of Labgroup, marked the start of Archiving 2.0.
Indeed, the certification of the first PSDC (Provider of Digitisation and Conservation Services), concretises the implementation of the law of the 25th of July 2015 on electronic archiving, and the establishment of the digital trust chain, which extends from the European Union to the holder of information, through the Luxembourg State and the third-party archiver.
PSDC certification, a long-standing work
As a third-party archiver for 40 years in Luxembourg, Labgroup had to prepare itself for the future by initiating its digital transformation in the early years of the 21st century. The strategy aimed to be the leading edge in the evolution towards a paperless society (or, in the medium term, with less paper). In parallel with investing in a state-of-the-art, highly protected storage and archiving infrastructure, Labgroup has developed a comprehensive and continuously improved Information Security Management System (ISMS).
These efforts to control risks were rewarded in 2014 by obtaining the ISO 27001 international certification (already a first for an archiver in Luxembourg), in terms of information security management covering all related activities (digitisation, physical and electronic archiving). With this first step achieved, it remained to obtain the new status of PSDC, created by the law of 25th July 2015 on electronic archiving.

As the first candidate, Labgroup was logically the first company whose processes and procedures conformed to the requirements of the PSDC standard, Labgroup was audited in November 2016. Following the positive verdict of the certifying body, ILNAS placed Labgroup on the list of legal persons with the status of PSDC under the number 2016/9/001 and implemented immediate supervision for which the institute is responsible.
Note that Labgroup is certified as:
- Provider of Digitisation Services, in other words, Labgroup is empowered to create legal electronic copies of paper documents;
- Provider of Conservation Services, which guarantees the integrity, confidentiality and persistence of electronic archives throughout their retention period.
This achievement, on the 40th year anniversary of the company’s creation, marks the beginning of a new era of growth for Labgroup!
Legal archiving, a trusted service.
Whether as a consumer or a company, we archive information to be able to (well) defend our own interests in the future, for example, our health in the case of medical data.
Since three millennia, the archiving of the writings is inseparable from its paper support. However, technological advances now make it possible to perform native electronic records, such as purchasing on an e-commerce site, and to dematerialise paper documents, such as signed contracts in a handwritten manner.
The legislator has considered these advances by creating a legal framework that anticipates and supports the irresistible digitisation of our society. The law of 25th of July 2015 on electronic archiving therefore recognises the probative value of electronic copies of paper documents produced by a PSDC certified company to respect all the conditions of strict fidelity to the original and, moreover, the presumption of conformity with the original.
It is therefore with confidence, with the guarantee of the state, that the holders of information can now choose between:
- continuing to outsource their paper records with Labgroup, or
- requesting Labgroup to digitise their paper archives, then destroy them and only keep the electronic copies.
In either case, Labgroup will proceed as required by the law and as schematised here below.
In order to strengthen citizens’ digital trust, the law stipulates that PSDC’s must provide its clients with a well-documented prior information package before the signing of any service contract. This documentation must be kept available by Labgroup.
Electronic archiving, an opportunity for Luxembourg
At European level, the eIDAS (Electronic Identification and Trust Services) regulation 910/2014, which has been fully implemented since the 1st of July 2016, has clearly demonstrated the willingness of member states to democratise digitisation by:
- enhancing the security of electronic exchanges;
- recognizing the universal value of the electronic signature;
- granting the legal value to a digital document.
While Luxembourg has been a precursor with this new law, other countries have also embarked on the path of digital transformation by introducing an attractive legal regime for electronic archiving. However, no other country engages the state through the certification of service providers, such as the PSDC status in Luxembourg.
By archiving in Luxembourg, companies in those countries could therefore both exploit their national legislation and benefit from the guarantees offered by the PSDC status.
Indeed, the rules and requirements to which Labgroup must comply as a PSDC are equivalent to those established by the Belgian law of July 21, 2016, called Digital Act, and the French decree of December 5, 2016 on the reliability of the copies and taken for the application of Article 1379 of the Civil Code.
The French and Belgian judges will therefore find, in the certified conformity of the PSDC in Luxembourg, objective reasons to rule favourably on the reliability of the digital copy.

Après dix-huit mois de travail à l’issue de l’adoption en juillet 2015 de la loi sur l’archivage électronique élaborée par le ministère de l’Économie, Labgroup a été certifié premier prestataire de services de dématérialisation ou de conservation et PECB premier organisme certificateur.
En soi, ce n’est pas une surprise. Encore fallait-il que l’annonce soit officialisée. C’est aujourd’hui fait, 1er février 2017. Un grand jour, selon Étienne Schneider, Vice-Premier ministre, ministre de l’Économie. Le Luxembourg est le seul pays dans l’UE actuellement doté d’un cadre légal opérationnel relatif à l’archivage électronique. En cohérence avec l’initiative Digital Lëtzebuerg, la législation en vigueur reconnaît notamment la valeur juridique des documents numériques et, sous certaines conditions, offre des garanties importantes quant à leur conformité à l’original. En outre, cette législation prévoit un nouveau statut -le fameux PSDC.
«Nous faisons un pas de plus dans la transposition de notre stratégie Digital Lëtzebuerg; nous allons pouvoir attirer de nouveaux acteurs économiques au Luxembourg, que ce soient des sociétés actives dans l’archivage électronique ou bien des sociétés qui souhaitent profiter de notre législation de référence pour l’archivage électronique de leurs propres documents», commente Étienne Schneider. Et d’ajouter : «C’est un pas de plus vers une économie basée sur les services.» En filigrane, l’espoir d’attirer de nouveaux prestataires et de nouveaux clients pour les prestataires certifiés, sachant qu’ils seront obligés de localiser les copies numériques sur le sol luxembourgeois.
Bernard Moreau, CEO, Labgroup, voit dans cette certification -la première !- une nouvelle étape pour son entreprise : «C’est une réelle opportunité pour nous après quarante ans d’archivage papier !» L’entreprise était fin prête. Voici quelques mois déjà, le LIST (Institut Luxembourgeois des Sciences et des Technologies) et PECB Europe avaient Labgroup à relever le défi de la conformité à des règles de plus en plus nombreuses et de la multiplication des audits. Et de présenter, ensemble, un système intégré de gestion des documents de référence, un SIG universel servant de dépôt central et unique de tous les documents de référence exigibles lors de l’implémentation, l’audit et la certification d’une réglementation, d’une norme ou d’une bonne pratique.
Le SIG avait déjà fait ses preuves lors de l’audit pour la certification ISO 27001 en 2014; un peu plus tard, Labgroup avait réussi le renouvellement de ses certifications ISO 9001 et ISO 27001, à la suite d’un seul processus d’audit, au lieu de deux. La société Labgroup, premier PSDC au Luxembourg
Ce jour 01 février 2017, l’ILNAS (Institut Luxembourgeois de la Normalisation, de l’Accréditation, de la Sécurité) officialise la certification du tiers-archiveur de métier comme premier Prestataire de Service de Dématérialisation et de Conservation (PSDC).
Le prestataire d’archivage électronique Lab Luxembourg S.A. a introduit sa notification pour surveillance le 6 octobre 2016. Cette notification a été référencée sous le numéro de dossier 2016/9/001 et constitue la première demande du statut de PSDC selon la loi du 25 juillet 2015 relative à l’archivage électronique.
Cette loi définit le cadre légal pour l’attribution du statut de PSDC, ainsi que les exigences pour l’audit de certification PSDC, qui se composent des mesures définies dans la norme ISO/IEC 27001:2013, complémentée d’exigences additionnelles pour la dématérialisation et la conservation de documents.
Le système de management de Lab Luxembourg S.A. a été audité le 28 octobre 2016, du 9 au 11 novembre 2016 et la levée des non-conformités mineures a été vérifiée le 7 décembre 2016.
Une réunion de surveillance entre l’ILNAS et Lab Luxembourg a eu lieu le 19 janvier 2017 et après la vérification de tous les éléments demandés, l’ILNAS a pu attribuer le statut de PSDC à la société Lab Luxembourg S.A. le 1er février 2017.
