Optimiser la gestion, la protection et la conservation des documents, tant physiques qu’électroniques, dans une optique “Paperless Office”, telle est la préoccupation des responsables d’entreprise à la recherche d’agilité et d’efficience.

Selon notre analyse du marché, les sociétés de taille moyenne à grande, dont la maturité en matière de gouvernance de l’information est déjà élevée et les moyens financiers importants, ont bien l’intention «d’y aller».

Labgroup and LIST collaborate to foster technological innovation

In order to better display their technological innovations to its visitors, LIST (Luxembourg Institute of Science and Technology, formerly Centre de Recherche Public Henri Tudor) inaugurated on the 22nd of September 2015 the “LIST Technological Showroom” in the presence of the Grand Duke, accompanied by several ministers, including the Prime Minister Xavier Bettel.

According to LIST, “the Showroom can be defined as a concentration of technologies “Made in Luxembourg”, developed by LIST and its industry partners in collaboration with Luxinnovation. It illustrates perfectly the positioning of the institute and its desire to reduce the existing gap between scientific research and businesses.” 

Labgroup, which has been one of the partners in the development of the new innovation “Trusted Data Hub” by LIST, exhibited and presented this new risk analysis tool.

Labgroup collaborates with LIST for several years, the only Research and Technology Organization (RTO) in the Grand Duchy of Luxembourg which dedicates its resources and knowledge to the development of science and technology.

In fact, the collaboration of LIST, Labgroup and other regulated companies and regulators made it possible to create a risk analysis tool that goes beyond the standard risk management procedures. This innovation enables the regulator of a business sector to have at any time a view of the overall security level in its sector.

Each company can now, in their sector, make its risk analysis and reports systematically and quicker. Moreover, an exchange of best practices between these different actors allows better control of the risk management process for all regulated companies and regulators. Labgroup has notably used the risk management tool in order to achieve ISO 27001 certification (information security standard) and to conform with Circular CSSF 12/544 (impact on reputation, operational, legal and financial impact) that covers a risk-based approach.

Beside this collaboration, Labgroup and the Luxembourg Institute of Science and Technology offer on a regular basis training courses and certifications to businesses that want to manage their own digitisation and electronic archiving projects.

Paperjam : Une loi pour répondre aux lacunes actuelles

Attendu de pied ferme depuis 2007, le nouveau texte sur les archives nationales a été approuvé le 30 octobre dernier en Conseil de gouvernement et présenté jeudi par Maggy Nagel (DP), ministre de la Culture. Objectif premier: combler le retard législatif.

Que ce soit les historiens ou les professionnels de la dématérialisation et du stockage de données, le projet de loi sur l’archivage suscite beaucoup d’attentes. Considéré par Maggy Nagel (DP), ministre de la Culture, «non seulement comme important mais comme un texte qui faisait cruellement défaut», le projet de loi vise avant tout à «combler les lacunes de la législation actuelle (…) dans l’intérêt de la mémoire collective du Luxembourg et des générations futures». Luxemburger Wort : Against the (piles of) paper

The ideal of running a business without the use of any paper has gone one step forward by the adoption of a law which introduces a new e-archiving legal framework in Luxembourg. The law of the 25th July 2015 acknowledges, under defined rules, the same legal value of electronic documents than paper documents. Digitized documents and copies will benefit from a legal presumption of conformity without any legal risk for the company if the paper document no longer exists.

The association FedISA organised Thursday evening an event that brought together specialized service providers with over 150 potential customers. The new law creates the PSDC status (Digitalization and Archiving Service). If the service provider comply with technical regulation requirements, the Luxembourg Institute of Standardisation, Accreditation, Safety and Quality of Products and Services (ILNAS) delivers this PSDC status.

The Director of FedISA, Lucas Colet, expects three to four companies that will consider to adopt the PSDC status. Three of them were present on the event: Numen, a French group which is situated in Howald, Labgroup which is located in Contern and Vectis. Labgroup and Vectis collaborate with big international names like Xerox or Fujitsu. International Groups that operates in Luxembourg or banks could also be interested in adopting the PSDC status instead of using an external service. However the costs to become a PSDC are enormous. Labgroup has already invested several hundreds of thousand euros.

What about the legal value?

The success of the electronic archiving depends on one question: Will a foreign judge acknowledge the legal value of an electronic document? The lawyer Cyril Pierre-Beausse which has been a part in the creation of the law, is optimistic. The law is based on the international standards of ISO 27001 which concerns the information security. Furthermore, a new EU-regulation “eIDAS” will arrive in July 2016 that oblige judges in the EU to no longer refuse electronic documents as evidence. According to Jean Racine, Manager at Labgroup, the new law in Luxembourg on the electronic archiving in conjunction with the EU-regulation offer important guarantees.

Luxembourg is the “first mover” on making the paper document and the electronic document equivalent. This pioneering role can be advantageous. It could make the country more attractive and competitive. International companies could be interested to move their headquarters to Luxembourg. According to experts, the neighbouring countries are also interested to change the law in the favour of the electronic archiving.

The change for a company to adopt the electronic archiving is difficult. Cyril Pierre-Beausse however highlights that the adoption will help to be prepared for the new EU Data Protection Reform Strategy. Companies have to destroy all of their documents which at the exact moment when they are no longer been used. In an electronic archiving system, this process can be automated.

New solution to scan and archive data

Discover the newest article on electronic archiving, released the 25th of September 2015, by the “Lëtzebuerger Journal”.

Labgroup from Contern and NG partners/Xerox have developed a new solution which enables the companies to scan data at their premises and to archive them securely at Labgroup. This solution, “made in Luxembourg”, will focus on small- and medium-sized businesses but will also interest the Big 4. The solution fulfils the requirements of the new law of the 25th July 2015, which introduces a new e-archiving framework. Labgroup is currently a candidate for the status “Digitalization and Archiving Service Provider” (PSDC), which will only be recognized after a certification process. The “e-Docubank” will be available from today on.

Labgroup has already been certified to ISO 27001. The common solutions have been, until now, that the documents were collected and scanned by Labgroup before being destroyed.

La dématérialisation consiste à remplacer les supports physiques de l’information (papier le plus souvent) par des fichiers de données informatiques traitées sur ordinateurs. Quand la substitution est complète, on parle de “bureau sans papier”, mais la première étape vers cet idéal  consiste à numériser (scanner) les documents papier afin de stocker leur image.

PSDC procedures by ILNAS

ILNAS, via the “Digital trust department”, is notably charged with the supervision of PSDCs that are established in the Grand Duchy of Luxembourg and offer services related to digitisation or conservation of documents. This document describes the scheme, requirements and process applied by the ILNAS – Digital Trust department for the supervision of PSDCs. The supervision scheme is based upon the law on electronic archiving of dd/mm/2013.

The purpose of this procedure consists to describe the process of supervising PSDCs. L’avenir du statut de PSF vu par l’association

Dans la foulée des discussions sur l’introduction au Luxembourg, à partir de 2015, de l’échange automatique d’informations entre administrations fiscales dans l’UE sur les revenus d’intérêt, les professionnels s’interrogent sur l’impact de cette décision sur la place financière.

Pour le cluster des PSF de support, il importe de constater que :

L’abandon du secret bancaire n’est pas absolu et ne touche actuellement, alors qu’une discussion est en cours à Bruxelles sur l’extension du champ d’application de la directive, que certains revenus. Aussi, cette mesure annoncée se limite à un échange d’informations entre administrations fiscales. L’obligation pour les professionnels du secteur financier de garantir la sécurité et confidentialité des informations vis-à-vis de toute autre tiers continue donc à exister.

Les obligations de gestion de risques opérationnels qui sont au coeur du statut ne sont pas du tout touchées par la directive. En effet, la CSSF vient de publier en 2012 une nouvelle circulaire 12/544 dite « risk based approach ». Cette circulaire est parfaitement alignée à l’objectif politique international de renforcer la gouvernance et réduire les risques liés aux activités financières.

Ce changement de paradigme qui s’imposait face à des tendances internationales irréversibles (FATCA, OCDE, etc.) est également source d’opportunités pour le secteur ICT au Luxembourg. Il est attendu qu’un nombre significatif d’acteurs existants de la place financière devront s’adapter à ce changement de situation et, pour des raisons évidentes de coût , pourront être amenés à sous-traiter leur informatique éventuellement pour passer d’un modèle Capex à un modèle Opex ou pour faire face à une complexité croissante des infrastructures. L’image de la place se trouve renforcée et de nouveaux investisseurs internationaux, désireux de profiter du cadre légal attractif et de l’expertise en matière de gestion de données sensibles, vont certainement se tourner davantage vers le Luxembourg.

Le statut du PSF continuera donc, à notre avis, de garder toute son importance. « Alors que tout le monde parle du Big Data et des opportunités économiques y associées, je suis convaincu que le Luxembourg possède tous les atouts pour se positionner au niveau international en tant que « Information Trust Center », tant pour le secteur financier que pour d’autres secteurs économiques », conclut Thierry Seignert, Président de l’association des PSF de support.

En effet, le « know how » dont le secteur ICT dispose à présent dans ce domaine et qui est intrinsèquement lié au statut de PSF de support reste unique au monde. Il importe à présent de suivre de près les évolutions réglementaires et de promouvoir ce cluster de compétence à l’étranger. L’association des PSF de support, en tant que membre du Haut Comité de la Place Financière, compte y jouer un rôle moteur.
