Labgroup and LIST collaborate to foster technological innovation

In order to better display their technological innovations to its visitors, LIST (Luxembourg Institute of Science and Technology, formerly Centre de Recherche Public Henri Tudor) inaugurated on the 22nd of September 2015 the “LIST Technological Showroom” in the presence of the Grand Duke, accompanied by several ministers, including the Prime Minister Xavier Bettel.

According to LIST, the Showroom can be defined as a concentration of technologies “Made in Luxembourg”, developed by LIST and its industry partners in collaboration with Luxinnovation. It illustrates perfectly the positioning of the institute and its desire to reduce the existing gap between scientific research and businesses.”

Labgroup, which has been one of the partners in the development of the new innovation “Trusted Data Hub” by LIST, exhibited and presented this new risk analysis tool.

Labgroup collaborates with LIST for several years, the only Research and Technology Organization (RTO) in the Grand Duchy of Luxembourg which dedicates its resources and knowledge to the development of science and technology.

In fact, the collaboration of LIST, Labgroup and other regulated companies and regulators made it possible to create a risk analysis tool that goes beyond the standard risk management procedures. This innovation enables the regulator of a business sector to have at any time a view of the overall security level in its sector.

Each company can now, in their sector, make its risk analysis and reports systematically and quicker. Moreover, an exchange of best practices between these different actors allows better control of the risk management process for all regulated companies and regulators. Labgroup has notably used the risk management tool in order to achieve ISO 27001 certification (information security standard) and to conform with Circular CSSF 12/544 (impact on reputation, operational, legal and financial impact) that covers a risk-based approach.

Beside this collaboration, Labgroup and the Luxembourg Institute of Science and Technology offer on a regular basis training courses and certifications to businesses that want to manage their own digitisation and electronic archiving projects.

For more information on the next training courses and certifications, please visit the “ILM Academy” section of our website or send an email to marketing@labgroup.com.

Paperjam : Une loi pour répondre aux lacunes actuelles

Discover the article on the national archives and the electronic archiving, released the 4th of November 2015, by “Paperjam”.

Labgroup and NG Partners/Xerox mobilise their combined expertise to assist customers in the archiving of their documents to achieve equivalent probative value (PSDC).

Stéphane Nonnweiler, Managing Director of NG Partners – Xerox dealer in Luxembourg – and Bernard Moreau, CEO of Labgroup, unveiled this Thursday 24th September 2015 the benefits of their combined competences in electronic archiving.

Together, the two associates propose a concrete and global offer which goes from the dematerialisation to the destruction of documents, through to electronic document management and the integrated conservation of the electronic archives.

NG Partners/Xerox, specialised in printing and document management and Labgroup, natural candidate for PSDC having been a third party archiver for 38 years, have already defined a strategyconcerning the adoption of the law of the 25th of July 2015 relative to electronic archiving.

This new law acknowledges the probative value of electronic copies of paper documents that therefore allows their destruction, and creates the PSDC status (Dematerialisation and Archiving Service Provider). The electronic archives, created and maintained by a certified company, benefit from the same legal value as the original document.

Companies can benefit by these advances in the law, enabling their users to:

  • scan the documents easily on a multifunctional device (preferably XEROX!),
  • OCR-process and index automatically the documents to ease future research,
  • transfer confidentially the electronic copies to Labgroup for secure archiving, probative archiving or for archiving of evidentiary value,
  • manage electronically all documents,
  • find easily archived documents thanks to a research engine such as Google
  • defend effectively your interests in case of litigation by producing the substantiating documents.

Furthermore, users will be able to continue to digitize paper documents without any need of change, the benefits of this solution offered by NG Partners/Xerox and Labgroup are numerous:

  • secure dematerialization of the information flow
  • increased compliance and guaranteed traceability
  • time savings in the research of information
  • greater productivity compared to classic methods

Luxemburger Wort : Against the (piles of) paper

Discover the article on electronic archiving, released the 18th of September 2015, by the “Luxemburger Wort”.

The ideal of running a business without the use of any paper has gone one step forward by the adoption of a law which introduces a new e-archiving legal framework in Luxembourg. The law of the 25th July 2015 acknowledges, under defined rules, the same legal value of electronic documents than paper documents. Digitized documents and copies will benefit from a legal presumption of conformity without any legal risk for the company if the paper document no longer exists.

The association FedISA organised Thursday evening an event that brought together specialized service providers with over 150 potential customers. The new law creates the PSDC status (Digitalization and Archiving Service). If the service provider comply with technical regulation requirements, the Luxembourg Institute of Standardisation, Accreditation, Safety and Quality of Products and Services (ILNAS) delivers this PSDC status.

The Director of FedISA, Lucas Colet, expects three to four companies that will consider to adopt the PSDC status. Three of them were present on the event: Numen, a French group which is situated in Howald, Labgroup which is located in Contern and Vectis. Labgroup and Vectis collaborate with big international names like Xerox or Fujitsu. International Groups that operates in Luxembourg or banks could also be interested in adopting the PSDC status instead of using an external service. However the costs to become a PSDC are enormous. Labgroup has already invested several hundreds of thousand euros.

What about the legal value?

The success of the electronic archiving depends on one question: Will a foreign judge acknowledge the legal value of an electronic document? The lawyer Cyril Pierre-Beausse which has been a part in the creation of the law, is optimistic. The law is based on the international standards of ISO 27001 which concerns the information security. Furthermore, a new EU-regulation “eIDAS” will arrive in July 2016 that oblige judges in the EU to no longer refuse electronic documents as evidence. According to Jean Racine, Manager at Labgroup, the new law in Luxembourg on the electronic archiving in conjunction with the EU-regulation offer important guarantees.

Luxembourg is the “first mover” on making the paper document and the electronic document equivalent. This pioneering role can be advantageous. It could make the country more attractive and competitive. International companies could be interested to move their headquarters to Luxembourg. According to experts, the neighbouring countries are also interested to change the law in the favour of the electronic archiving.

The change for a company to adopt the electronic archiving is difficult. Cyril Pierre-Beausse however highlights that the adoption will help to be prepared for the new EU Data Protection Reform Strategy. Companies have to destroy all of their documents which at the exact moment when they are no longer been used. In an electronic archiving system, this process can be automated.

New solution to scan and archive data

Discover the newest article on electronic archiving, released the 25th of September 2015, by the “Lëtzebuerger Journal”.

Labgroup from Contern and NG partners/Xerox have developed a new solution which enables the companies to scan data at their premises and to archive them securely at Labgroup. This solution, “made in Luxembourg”, will focus on small- and medium-sized businesses but will also interest the Big 4. The solution fulfils the requirements of the new law of the 25th July 2015, which introduces a new e-archiving framework. Labgroup is currently a candidate for the status “Digitalization and Archiving Service Provider” (PSDC), which will only be recognized after a certification process. The “e-Docubank” will be available from today on.

Labgroup has already been certified to ISO 27001. The common solutions have been, until now, that the documents were collected and scanned by Labgroup before being destroyed.

New e-archiving legal framework

Update 04/08/2015

This Act “Loi du 25 juillet 2015 relative à l’archivage électronique et portant modification:1. de l’article 1334 du Code civil;
2. de l’article 16 du Code de commerce;
3. de la loi modifiée du 5 avril 1993 relative au secteur financier”was published in the Official Journal of the Grand Duchy of Luxembourg MEMORIAL year dated August 04, 2015 under A – No. 150. The full text can be accessed here. For over years, Luxembourg is pursuing its aim to become the « European fortress for electronic data ». The draft law no 6543 on electronic archiving was adopted on Thursday 2nd July 2015. The law of the 25th July 2015 introduces a new e-archiving legal framework in Luxembourg and creates the PSDC status. The main feature of the law is to acknowledge legal value of electronic copies. Digitalized documents and copies made by a PSDC (Digitalization and Archiving Service Provider) will benefit from a legal presumption: the digitalized copy will be presumed to be in conformity with and be equivalent to the original document. An electronic copy cannot anymore be refused as an evidence just because of its electronic nature.

In order to become PSDC, companies must comply with technical regulation requirements and measures. PSDC status guarantee that digitalization and archiving procedures are secure and reliable. The technical requirements are based on ISO 27001 and 27002. Already certified ISO 27001 since 2014, Labgroup is an ideal candidate to obtain the PSDC status. The PSDC status is delivered by the Luxembourg Office of Accreditation and Surveillance (OLAS) and a notification has to be made to the Luxembourg Institute of Standardisation, Accreditation, Safety and Quality of Products and Services (ILNAS). A full list of the PSDC companies will be soon available at this page.

Choosing a PSDC is the guarantee that:

-You will benefit from conformity and authenticity presumption,
-You will deal with trusted a third-party which respect the professional secrecy,
-You will manage information easily and be compliant with legal constraints.

To help you to grasp these challenges, Labgroup and Luxembourg Institute of Science and Technology (LIST) are partnering to propose trainings on Information Lifecycle Management (ILM), digitisation and electronic archiving. More information are available here. You can already register for the session of date.
